- Update on NNC Issues - FSA, the Florida League of Cities and several local governments filed a notice of intent to appeal the Court’s February 18, 2012 Order concerning EPA’s regulations. View the Report Here and the joint letter from FSA, the Florida League of Cities and the Florida Association of Counties to EPA urging the approval of the FDEP NNC regulations.
- Key West SWU Litigation – On April 30, 2012 the City of Key West petitioned the Florida Supreme Court to review a decision of the Third District Court of Appeal finding that the Florida Keys Community College enjoys “sovereign immunity” and is not liable for the payment of stormwater utility fees. FSA and the League of Cities will file briefs in support of the City if the Supreme Court agrees to hear the appeal.
- Los Angeles' Appeal to US Supreme Court - No word from the US Supreme Court on whether they will accept a petition by Los Angeles County of a decision by the 9th Circuit Court of Appeals. The 9th Circuit had ruled that an MS4 permittee is responsible for excess stormwater discharges containing pollutants at levels above permitted limits, even if those pollutants originated outside of the jurisdiction's storm sewer system. FSA filed a “Friend of the Court” brief supporting the County’s request.
